Privacy Policy

This Privacy Policy explains how ELITE SQUARE PTY LTD (ABN 27 651 232 101) (in this Policy, "ELITE SQUARE", "we", "us", or "our") collects, uses, stores, discloses, and protects personal information when you visit our website at elitesquare.com.au (the "Site").

ELITE SQUARE is an Australian company incorporated in Queensland and is bound by the Privacy Act 1988 (Cth) (the "Privacy Act") and the Australian Privacy Principles ("APPs"). This Policy is written to satisfy our obligations under APP 1.3 and to give you a clear, plain-English account of what happens to your information when you interact with this Site.

This Policy applies only to this Site. Our products — including SportLoop and our forthcoming cloud data platform — collect different categories of information, for different purposes, and are governed by their own privacy policies published with each product. If you are looking for the SportLoop privacy policy, please refer to the SportLoop application or the policy published at the SportLoop website.

1. About this Policy

We have written this Policy to be read by a human, not a lawyer. We have tried not to use defined terms where plain English will do. Where we have used them, we have explained them in context. We have also tried not to claim practices we don't actually follow — short, accurate, and honest is more useful to you than long, comprehensive, and partly aspirational.

You should read this Policy before using the Site. By continuing to use the Site, you confirm that you have read and understood how we handle your information as described here. If you do not agree with anything in this Policy, please do not use the Site, and feel free to contact us with your concern.

2. What we mean by "personal information"

"Personal information" has the meaning given in section 6(1) of the Privacy Act: information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether recorded in a material form or not.

In the context of this Site, the personal information we deal with falls into two narrow categories: technical information collected automatically when you load a page, and the contents of any email you choose to send us. Both are described in detail below.

3. Information we collect

3.1 Information you give us directly

We collect personal information from you when you choose to contact us. If you send an email to contact@elitesquare.com.au, we receive and retain:

  • your email address;
  • any name you include in the message;
  • the contents of your message and any reply we send;
  • the date and time the message was sent and received; and
  • any other information you voluntarily include in the message (such as a phone number, the name of an organisation, or attachments).

We do not operate web forms, account signups, mailing-list opt-ins, or any other input collection on this Site. Email is the only direct channel through which we receive personal information.

3.2 Information collected automatically

When your browser loads a page on this Site, our hosting infrastructure receives the following information as a normal part of any HTTP request:

  • your Internet Protocol (IP) address;
  • the page you requested;
  • the date and time of the request;
  • the user-agent string your browser sends (typically describing the browser, operating system, and device class);
  • the referring page, where one is supplied by your browser; and
  • the HTTP status of the response we returned.

This information is recorded in standard server access logs by our hosting provider, Cloudflare Pages. The logs are retained for up to thirty (30) days, after which they are deleted by the provider in the ordinary course of its operations.

3.3 Cookies and similar technologies

This Site does not set any cookies for analytics, tracking, advertising, or behavioural profiling. We do not embed third-party analytics scripts such as Google Analytics, Meta Pixel, or any similar tooling.

Your browser may set cookies of its own (for example, related to its language or session state) which we cannot see and do not use. Some assets on this Site are served from third parties (most notably Google Fonts and Cloudflare's CDN); those providers may receive your IP address as a consequence of normal HTTP requests when those assets load. We have deliberately kept the list of such third parties short.

3.4 Sensitive information

"Sensitive information", as defined in the Privacy Act, includes information about a person's racial or ethnic origin, political opinions, religious beliefs, sexual orientation, criminal record, or health. We do not collect sensitive information through this Site and we ask that you not include sensitive information in any email you send us, unless it is strictly necessary for the matter you are writing about.

3.5 Children's information

This Site is intended for a general audience and is not directed at children. We do not knowingly collect personal information from children under 16 through this Site. If you believe a child has sent personal information to us in error, please contact us and we will take reasonable steps to delete the information.

4. How we use the information we collect

We use the personal information we collect for the following purposes, and for no others:

  • To respond to you. If you email us, we use the contents of your message and your reply-to address to read your message, consider it, and respond.
  • To operate and secure the Site. We use server logs to detect and respond to abusive traffic (such as automated scraping, denial-of-service attempts, and probing for security weaknesses), to diagnose performance problems, and to confirm that the Site is reachable.
  • To improve the Site. Aggregated and de-identified statistics derived from server logs (such as which pages are loaded most often) may inform our editorial decisions about what to publish or remove. We do not derive individual profiles from this analysis.
  • To meet our legal obligations. We may retain or disclose information where required to do so by Australian law, by a court order, or by a lawful request from an Australian government authority acting within its powers.

We do not use the personal information we collect through this Site to send marketing or promotional communications. We do not add email addresses we receive to any mailing list. We do not sell, rent, or licence personal information to third parties for any purpose.

5. Lawful basis for collection

Our collection of personal information is reasonably necessary for our functions and activities as a small Australian software studio operating a public website, and is conducted in accordance with the Privacy Act and the Australian Privacy Principles. Where you provide personal information by emailing us, your collection is by your voluntary act. Where personal information is collected automatically through your use of the Site (for example, server logs), its collection is necessary to deliver and secure the Site to you.

6. When we disclose information

We disclose personal information only in the following narrow circumstances:

  • To our service providers. Our hosting provider (Cloudflare, Inc., trading in Australia as Cloudflare Australia Pty Ltd), our email provider, and the registrar for our domain name necessarily receive technical information in order to deliver their services to us. We choose providers that maintain reasonable security practices and that publish their own privacy policies.
  • To comply with the law. We may disclose personal information where we are required or permitted to do so by Australian law, by a court order, or by a lawful request from an Australian government or law-enforcement authority acting within its powers. Where it is lawful and practical to do so, we will give you advance notice of any such disclosure.
  • To protect rights and safety. We may disclose personal information where we reasonably believe it is necessary to protect the rights, property, or personal safety of ELITE SQUARE, our employees, our users, or members of the public.
  • To a successor entity. If our business is sold, merged, or transferred to another party, personal information may be transferred as part of that transaction, subject to the recipient agreeing to handle the information in a way consistent with this Policy.

We do not disclose personal information to advertisers, data brokers, or analytics platforms.

7. Cross-border disclosure

Our hosting provider operates a global content delivery network. As a consequence, your HTTP requests to this Site may be processed by edge servers physically located outside Australia, including in the United States, Singapore, and other jurisdictions. Information transmitted via those edge servers is encrypted in transit (HTTPS / TLS 1.2 or higher) and is not stored offshore in any substantive sense; the processing performed at the edge is limited to routing the request and returning the response.

We do not deliberately transfer personal information overseas for any other purpose. Where APP 8 (cross-border disclosure of personal information) applies to a particular transfer, we will take reasonable steps to ensure the overseas recipient does not breach the APPs in relation to the information.

8. How we store and protect information

We hold personal information in electronic form using systems operated by reputable Australian and international service providers. We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, and disclosure. Those steps include:

  • serving the Site exclusively over encrypted HTTPS connections (TLS 1.2 or higher);
  • using strong, unique passwords and two-factor authentication for our administrative accounts;
  • restricting access to email correspondence to those people within ELITE SQUARE who need it to perform their role;
  • relying on hosting and email providers that maintain industry-standard physical and operational security; and
  • not retaining personal information for longer than we need it (see Section 9).

No system connected to the internet is completely secure. We cannot guarantee the security of information transmitted to or from us, and you transmit information at your own risk. If you have particular sensitivity concerns about something you want to send us, please contact us first to arrange a more secure channel.

9. Retention and deletion

We retain personal information only for as long as is reasonably necessary for the purpose for which it was collected, or as required by law.

  • Server logs: retained by our hosting provider for up to 30 days, then deleted in the ordinary course.
  • Email correspondence: retained for as long as is reasonably necessary to handle the matter you wrote to us about and to refer back to it in the event of a follow-up. Inactive threads are reviewed periodically and deleted when they no longer serve a business purpose.
  • Information retained to comply with the law: retained for the period required by the relevant law, then deleted.

You may ask us to delete email correspondence you have sent us at any time (see Section 10).

10. Your rights

Under the Privacy Act and the Australian Privacy Principles, you have the following rights in relation to personal information we hold about you:

  • Right of access (APP 12): you can ask us to confirm what personal information we hold about you and to provide you with a copy.
  • Right of correction (APP 13): you can ask us to correct personal information that is inaccurate, out of date, incomplete, irrelevant, or misleading.
  • Right of deletion: you can ask us to delete the email correspondence you have sent us, subject to any overriding legal obligation we may have to retain it.
  • Right to withdraw consent: where we rely on your consent to do something, you can withdraw it at any time without affecting the lawfulness of what we did before you withdrew.
  • Right to complain: you can raise a complaint with us (see Section 11) or with the Office of the Australian Information Commissioner (see Section 12).

To exercise any of these rights, please email contact@elitesquare.com.au. We do not charge for handling a reasonable request. We aim to respond within five (5) business days and, in any case, within the thirty (30) day period required by the APPs. We may need to verify your identity before acting on a request, in order to protect you from information being released to someone else.

11. Complaints

If you believe we have handled your personal information in a way that breaches the Privacy Act or the APPs, please contact us first at contact@elitesquare.com.au with the details of your concern. We take privacy complaints seriously. We will acknowledge your complaint within five (5) business days and aim to provide a substantive response within thirty (30) days, including the steps we propose to take to resolve the matter.

We would much rather hear from you first so that we can put things right.

If you are not satisfied with our response to your complaint, you have the right to raise it with the Office of the Australian Information Commissioner ("OAIC"). The OAIC's contact details are:

13. Data breach notification

ELITE SQUARE is subject to the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act. In the event of an "eligible data breach" — broadly, an unauthorised access to, disclosure of, or loss of personal information that is likely to result in serious harm to an affected individual — we will notify each affected individual and the OAIC as soon as practicable after becoming aware of the breach, in accordance with our obligations under that scheme.

Given the narrow categories of personal information we hold via this Site, the prospect of an eligible data breach affecting Site visitors is low. We mention it here because we take the obligation seriously, not because we anticipate ever needing to act on it.

14. Automated decision-making

We do not use the personal information we collect through this Site to make automated decisions that have a legal or similarly significant effect on you. We do not profile visitors, score visitors, or use machine-learning systems to draw inferences about individuals from Site activity.

15. Links to other websites

This Site contains links to websites operated by parties other than ELITE SQUARE, including (for example) the website of the Office of the Australian Information Commissioner. We are not responsible for the privacy practices of those other websites. If you follow a link, we recommend you read the privacy policy of the destination site to understand how it handles your information.

16. Our products and this Site

This Policy covers this Site (elitesquare.com.au) only.

SportLoop and our forthcoming cloud data platform are separate products that collect different categories of personal information, for different purposes, from different categories of people (registered users rather than anonymous website visitors). Each product is governed by its own privacy policy, published with the product, written for that product's specific data flows, and updated independently of this Site policy.

Where this Site contains general statements about how those products handle data, those statements are summaries written for a marketing audience and are not the product's privacy policy. In the event of any inconsistency between this Site and a product's privacy policy, the product's privacy policy applies in relation to that product.

17. Changes to this Policy

We may update this Policy from time to time. We will update the "Last updated" date and version number at the top of this page whenever we do so. Where we make a material change — that is, a change that meaningfully expands the categories of information we collect, the purposes for which we use it, or the parties with whom we share it — we will additionally place a notice on the home page of the Site for a reasonable period.

Continuing to use the Site after a change to this Policy means you have accepted the updated Policy. If you do not accept a change, your remedy is to stop using the Site and, if you wish, to ask us to delete any email correspondence you have sent us under Section 10.
